Section 504
What is Section 504?
Section 504 is part of the Rehabilitation Act of 1973 that prohibits discrimination based upon disability. Section 504 provides that: "No otherwise qualified individual with a disability in the United States... shall, solely by reason of his or her disability, be excluded from the participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance ..." [34 C.F.R. § 104.4(a)]. To be protected under Section 504, a student must be determined to: (1) have a physical or mental impairment that substantially limit one or more major life activities; or (2) have a record of such an impairment; or (3) be regarded as having such an impairment.
Questions for Section 504 Eligibility
- Does the student have a physical or mental impairment?
- Does the physical or mental impairment affect one or more major life activity?
- Does the physical or mental impairment substantially limit a major life activity?
If the answer is Yes to all three questions, a Section 504 plan should be developed.
